veryblah214, Being 10 years old when I had the site up tells me everything on why you would post such a long misdirected comment. The videos on MorbidTech were NEVER I repeat NEVER offered for sale!!! They were NEVER offered for download either!!! They were only available for STREAMING from our servers!!! Only if you paid a monthly access fee could you STREAM them. It even said in the agreement you had to confirm that YOU DO NOT OWN OUR VIDEOS and THEY ARE NOT AVAILABLE FOR DOWNLOAD!!! One of our subscribers took it upon himself to cheat and find a way to copy / download almost all of our videos (that is why they looks so crappy and some are not complete.) That person STOLE our videos right from the start!!! He posted them on this site and others and it took off from there... a crime being committed each download and file that was shared. So "frangel" and your "oh please, what did you expect...?" comment is indicative that you are a careless person that is dishonest and has no respect for anyones work or anyone other than your own ugly thieving self. (maybe I can mail you an HD copy? would that make you feel like business as usual in your world?) Shame on you! veryblah214 and the rest of you, too dishonest to do things the right way, people should not comment on stuff unless you have ALL the facts. So after you people insult me and post such crappy comments, WTF makes you think I will EVER let you see the complete series or let you be a member of that site if I should start it up again or start a similar site? With thieves like you, I wouldn't be able to stay in business because you think you should get it all for free, you think it is your duty to steal and distribute my work for free. I notice you guys are not my "friends" either... big shocker there! In my book you are thieving pigs, no disrespect for those that have asked nicely to be my friend and if you could "buy" a copy of your favorite MT Videos. I am sorry, but not at this time. Great. You addressed one point I made. My age. I honestly don't know when MorbidTech was around. I wasn't aware of it when it was. I assure you I'm old enough to make a valid argument. Look. I apologize for whatever perceived disrespect you feel. I was really just curious as to your rationale, and I don't think it warranted being called a "thieving pig." I didn't even know about the MorbidTech videos until this site. Even then, I didn't know you were still around until very recently. I understand that it's your work, but when most people create something they like to share it. Not necessarily for free, but I never meant to imply that. Since your work isn't even available for purchase, though, what other option is there except for people to download whatever version they can find??

My post was in response to all of the recent posts, not just yours. However, stealing is stealing no matter if the videos are for sale or not or if they ever were for sale, which they NEVER were! THEY ARE NOT FOR SALE. As far as the "queen" remark, it is a damn shame that you posting your comments like that only makes me not want to ever release the videos for sale which ruins it for those that have asked nicely without all the hateful (I think I can say whatever I want) typical faggot comments and snide remarks like I owe you the videos for free now because they are not currently for sale. Queen? I am sure you are trying to imply that I am some sort of light-weight nellie bitch that is cranky maybe? I was a highly trained tactical officer for 5 years, talked people out of committing suicide, dealt is such bad situations that would make you run crying for momma, had to use deadly force to protect myself and others, too bad you are hiding behind a screen name and not here in front of me... I can't help but wonder: had people on this site not started trading those videos and showing interest, would you even be around? It's awfully convenient now that you have all sorts of interest to say "oh ya I'm working on safely releasing the videos." I call bullshit. You can refute that as much as you want--never any way to really know for sure.

Thought this was extremely relevant to this situation. This is someone from another forum trying to explain copyright law in laymen terms.

"I am in no way a lawyer, but the way I understand copyright law, and the only way it would be even remotely fair socially, is if the law views copyrights in the following way. File sharing is not theft, its copyright infringement, a civil matter where you break an all encompassing contract set by the government. Copyright simply sets the rules for duplication, not acquisition of a work. You are only required to get authority to duplicate a work, not purchase or consume it. When you download from torrents you are both downloading and uploading the content, so you become a distributor. But with megaupload you are only downloading, so you are only a consumer of the work. The only people duplicating the work are the original uploader and Megaupload. Since there are laws protecting service providers, the only person, as long as megaupload removes the material upon request, is the uploader. So whoever duplicates a work is expected to acquire and validate their rights to duplicate it. If you do not validate that authority, distribute the file and later find the person who gave it to you did not have authority to pass on the right to copy, you are guilty of copyright infringement.

This is different from stealing something in many ways. During theft there is a physical good removed, and the party has lost the ability to make a profit from that object stolen. So to the dismay of the copyright industry, there is a distinction made between copyright infringement and theft. Its with good reason too, when you take something from a store its quite clear that it is theft, as rarely can something be expected to be free. In that view, filesharing is more like taking something from someones garbage, you assume the person is giving it away. But even that is not really accurate. The best way to look at it is that you assume people have the right to send you the file, and you have no need to concern yourself with that because if they are sending it to you, they are telling you they have the right to copy the file and you have the right to download it. If this was not the law it would be impossible to live without infringing copyright. You would have to check the source of the image used on a billboard before viewing it, because if it was infringing copyright you would also be liable. Another example would be a website, all websites have intellectual property, you do not have to verify the content for the authority to be on the site, you just read it."

So basically, those of us who had downloaded the videos for our own viewing pleasure and did not redistribute it did absolutely nothing illegal. It's not even considered theft.

A service like videobam, mediafire and imagebeam and the like are all protected only up to the point that I send them notification that it is copyrighted material. They fail to remove it from their servers in a reasonable amount of time after our request / notification and they are liable as well. They know this and they always promptly remove the videos every time. Ever wonder why 99% of the links to our videos do not work anymore? So go right ahead and have it on your personal computer... you won't ever see me face to face but one of our attorney's will very likely see you in court and if you don't want to show, well, we will take judgement against you and relentlessly pursue you for the money like we have for our other sites. Kennedy, Sal and everyone else that felt they needed to put their 2 cents in with this thread... if you were in my shoes you might be twice as offended when someone demeans your hard work and trades it around for free like common every day porn. So in light of your two-faced behavior "veryblah214" you just made the decision for me on what to do. I was trying to find a way to "safely" make the videos available for those that respect the work, enjoy it and maybe could not afford to pay for it but would almost give anything to see a near HD copy of the ones already out, the two that nobody seems to have, "Lucas & Armando" because the original thief forgot to steal those before I shut everything down. Plus the five (5) that no one has seen and they are by far the hottest of the series. Yep thanks to you and your awful treatment of me in this open forum and how you try to justify the theft of my work to everyone when most people can read / see through your "legal opinion" and jargon trying to justify theft of my intellectual property... you sir ruined it for EVERYONE!!! Because of all the horrible treatment, name calling and such. I will NEVER EVER RELEASE those videos now. That is it... issue done! So much negativity in one forum. . . I think the best way to solve this is to simply forget about it. If he doesn't want to release or make more morbidtech videos, then okay. It's not too hard to start your own video series like this, and anyone who does it can make a good profit from people here and those still out there. Morbidtech was really good, but it won't be the last of its kind. So everyone wait until a new similar series is made. . . or make it yourself.

I said what I had to say, and I believe my legal interpretation to be solid. If any of you would do more than 2 seconds of research on copyright laws, you would know that there really isn't anything definite written in the books on the subject other than concerning the duplication of copyrighted material, and that the "laws" in this case are mostly derived from past court proceedings and rulings. Don't let Morbidtech fool you with his inflammatory language and all this "theft" bullshit. It just makes him feel big and important to have something you all desire that you can't have.

P.S. If you look, the only "name" I ever called Morbidtech was a queen. He called us thieving pigs and faggots, among a few others, multiple times. I repeatedly praised him for his work and attempted to discuss his concerns respectfully, but that was consistently overlooked.

P.P.S Morbidtech, if you look, I pmed you AFTER posting in this forum. I had some time to think and felt bad about my initial responses. I don't really feel bad anymore, though, because you just keep proving my points.

I do apologize to all extraneous parties involved who have had to witness what must seem like an awful lot of self-indulgent rambling, but when I initially replied in this thread I was really only reacting to what I perceived as an attack against our community. According to MorbidTech's definition of "theft" I guarantee you we are all thieves, himself included. There is simply no way to ensure that all the material we download has been authenticated and is free from copyright restrictions. It's IMPOSSIBLE. Look through your collections and tell me you don't have stuff in there that you didn't pay for. If you didn't pay for it, chances are somebody at some point uploaded it. Probably illegally. Half this site would be breaking copyright laws, according to MorbidTech's definition.

That was really my main point, and I'm sorry if I wandered from that out of frustration. I don't appreciate being called a thief, and I don't appreciate it when legitimate concerns are raised about one's line of argumentation, and they completely ignore it.

At this point I have to warn anybody who might not want their names brought up in any legal proceedings to not post in this thread, as it seems MorbidTech is threatening to sue me. At this point I have copied all posts and will save them for use as evidence should MorbidTech carry out his threat, to prove that MorbidTech and his supposed legal team are using our countries court systems to carry out a personal vendetta. As MorbidTech himself said, they are on a "war path." This is a shameful abuse of our countries justice system, and it's highly illegal.

I will not be posting any further in this thread, but I will be back to review and save further posts relating to this situation.
